Pelican’s Heart is operated by Thomas Lally (“Pelican’s Heart,” “we,” “us,” or “our”).
We value the trust you place in us. This Privacy Policy explains how we collect, use, and disclose personal information when you visit pelicansheart.com, request a free resource, join an email list or product waitlist, or communicate with us.

1. Information we collect
Information you provide. When you sign up, we collect your email address and any name or other information you choose to provide. We also keep information about your signup, such as which resource or waitlist you requested, your communication preferences, and the date and source of your subscription.
Messages and social interactions. When you contact us by email or through Instagram or another social platform, we receive the content you send and the contact or profile information the platform makes available to us. This can include your username, messages, and interactions with our automated replies.
Technical information. When you visit our website, our website and security providers may process information such as your IP address, browser and device details, pages requested, referring page, and the date and time of access. This information supports delivery, security, and troubleshooting. Additional website tracking is described in Section 4.
Email information. Our email provider processes delivery, bounce, and unsubscribe information. Where open or click tracking is enabled, it also records interactions with our emails, subject to applicable requirements and your choices. Email-tracking technologies can include small images and redirected links.
Our landing-page signup forms do not request payment-card information.
2. How we use information
We use information to deliver resources you request; maintain email lists and waitlists; send the updates, product news, and offers described when you sign up; respond to questions; and provide customer support.
We also use relevant information to operate and secure the website, prevent abuse, troubleshoot problems, evaluate permitted website and email performance, and improve our products and communications. We keep records needed to document subscription choices, honor opt-outs, and comply with legal obligations.
Joining one product waitlist does not automatically enroll you in another product-specific waitlist. We may send broader Pelican’s Heart communications when these are covered by your signup choice.
3. How we disclose information
We use service providers to help operate our website and communications. These include Klaviyo for email subscriptions and messaging, Cloudflare for website delivery and security, and ManyChat for automated social-media conversations. Providers receive information relevant to the functions they perform for us.
We may also disclose relevant information when reasonably necessary to comply with law or a valid legal request, protect people and our services, or obtain professional advice subject to appropriate confidentiality protections.
We do not sell personal information, rent our mailing lists, or provide subscriber lists to other businesses for their own marketing. We do not disclose personal information for cross-context behavioral advertising, meaning advertising targeted using activity across different businesses’ websites or services.
4. Website cookies and tracking choices
We use necessary technologies to operate and protect the website and remember privacy choices. With your permission, we also use Klaviyo tracking to understand page visits and signup activity. When a visitor is identified through a form or email link, this activity can be connected to their subscriber profile. Optional tracking stays off unless you allow it. You can accept or reject optional tracking, or change your choice later, through Cookie Settings. Rejecting optional tracking does not prevent you from requesting a resource or joining an email list.
Your email-subscription choice is separate from your website cookie choices. Unsubscribing from emails does not necessarily delete browser cookies. Changing cookie settings does not automatically unsubscribe you from emails.
For questions about email-open or click tracking, contact us at the email address in this policy. We will address applicable privacy choices without requiring you to unsubscribe from marketing where a separate tracking choice is required by law.
5. Your choices and privacy requests
You can unsubscribe from marketing emails at any time using the unsubscribe link in a marketing email. You can also contact us to request that we stop sending marketing messages. We will honor your request as required by applicable law. You do not need to provide identity documents to unsubscribe.
You may contact us to ask about personal information we hold about you or request access, correction, or deletion. Depending on your location and the laws applicable to us, you may have additional rights, such as receiving a copy of your information, objecting to or restricting certain uses, or withdrawing consent.
For requests involving access to or deletion of information, we may need to verify your identity using information reasonably necessary for that request. Some information may need to be retained for legal requirements or to honor your communication preferences. We will explain relevant limitations when responding.
Where applicable law gives you a right to appeal our decision, you can contact us using the same address and identify your message as a privacy appeal. You may also have a right to complain to a relevant privacy regulator.
6. How long we keep information
We retain personal information for as long as reasonably needed for the purposes described in this policy. Relevant factors include whether you remain subscribed, whether we are handling an inquiry or providing support, and applicable legal or recordkeeping requirements.
After you unsubscribe, we may retain a limited record of your email address and opt-out preference to help ensure you are not added back to marketing without permission. Deleting a marketing profile does not necessarily require deleting information we must keep to honor an opt-out or comply with law.
7. Security and processing locations
We use reasonable administrative and technical safeguards appropriate to the information we handle. No website, email service, or method of electronic storage can guarantee complete security.
We operate in the United States, and our service providers may process information in the United States and other countries. Privacy laws in those countries may differ from those where you live. Where applicable law requires safeguards for international transfers, we will use the required safeguards.
8. Children’s privacy
Our website and email signup forms are intended for adults, including parents and caregivers. They are not directed to children under 13, and we do not knowingly collect personal information directly from children under 13.
Please do not submit children’s personal information through our signup forms. If you believe a child has provided personal information directly to us, contact us so we can review and address it, including deleting it where required.
9. Other websites and services
Our pages and emails may link to Etsy, Instagram, Google Drive, or other outside services. When you follow those links, the outside service’s own privacy practices also apply.
Purchases made through Etsy are handled through Etsy rather than these landing-page forms. Etsy may provide us with order or contact information needed to fulfill an order, provide support, or maintain required business records. An Etsy purchase does not automatically subscribe you to our marketing emails.
10. Changes to this policy
We may update this policy as our services or practices change. We will post the revised policy here and update its effective date. For material changes, we will provide additional notice, such as a prominent website notice or an email, as appropriate and as required by law. Where a change requires consent, we will request that consent before applying the change.

Website technology details
We store your optional analytics choice in your browser using ph_privacy_choice for up to 180 days. A necessary Klaviyo opt-out cookie, __kla_off, tells Klaviyo tracking to stay off when you have not accepted analytics. We do not load Klaviyo’s website analytics script until you accept.
If you accept, Klaviyo may use its first-party __kla_id cookie to identify your browser and connect permitted visits to your subscriber profile. Klaviyo describes a lifetime of up to two years, subject to browser limits. Its browser storage can also include __kl_key, klaviyoOnsite, kl-post-identification-sync, $referrer, and $last_referrer for identification and visit context. These entries can persist between visits until they expire or are removed. Cookie Settings lets you withdraw your choice. Withdrawal removes accessible Klaviyo tracking cookies and these storage entries and stops loading analytics; it does not delete information previously collected.
We keep optional website analytics off when your browser sends Global Privacy Control or the legacy Do Not Track signal. These signals do not unsubscribe you from emails. This launch configuration has no advertising pixels or audience matching.
Submitting a signup sends your email address and the signup notice/version to Klaviyo to process your subscription even when optional analytics are off. The email address is not stored in our website’s browser storage. Fonts, images, and videos are hosted with the site through Cloudflare.
